The court affirmed an order denying one defendant’s motion to vacate default judgment, request for an evidentiary hearing, and motion to dismiss the complaint in its entirety.
By obtaining this victory, Mr. Caravella was able to save the plaintiffs from expensive discovery practice and time-consuming hearings while ensuring the defense’s arguments were tossed out due to their failure to timely answer or provide a reasonable excuse for their default. Mr. Caravella was also able to secure legal cost recovery for the plaintiffs.

Though originally filed in 2021, the matter was brought to recover damages surrounding a breach of construction contract by providing defective work. Although the defendant attempted to vacate a 2022 default judgment, he was unable to effectively demonstrate any legal grounds to set aside the judgment, with the Appellate Division rejecting such excuses as ignorance of the law and alleged medical problems that only occurred after the default.
